Abstract

Background. The issues of ensuring equality and overcoming the consequences of racial discrimination are one of the key elements of the modern US legal system. Participating in all aspects of public life, they are reflected in the implementation of the electoral rights of citizens, acquiring a special interpretation that is different from the generally accepted approach. The subject of the research is social relations arising from the exercise of the electoral rights of citizens, regardless of race and nationality. The purpose of the research is to analyze the approach of the US Supreme Court to electoral disputes and to identify the place of the racial factor in such cases.
Materials and methods. The implementation of the research tasks was achieved on the basis of an analysis of US legislation and judicial practice.
Results. The decisions of the US Supreme Court on electoral disputes, the interaction of the position on them with the doctrine of affirmative actions are investigated.
Conclusions. Despite the doctrine of affirmative actions, which occupies an essential place in the practice of the highest judicial body, the US Supreme Court excludes the factor of race, including the affirmative, in matters of exercising electoral rights.
